USPTO Launches Automated Search Pilot Program: A New Era for AI-Assisted Patent Examination

The U.S. Patent and Trademark Office (USPTO) is taking another step toward integrating artificial intelligence into the patent examination process. With the launch of the Automated Search Pilot Program (ASPP), the agency aims to explore how AI can improve search quality, efficiency, and early engagement between applicants and examiners.

Published in the Federal Register on October 8, 2025 (Docket No. PTO-P-2024-0022), the pilot program will begin accepting petitions on October 20, 2025, and continue through April 20, 2026, or until all available spots are filled.

What the Pilot Program Does

At its core, the Automated Search Pilot Program tests an internal USPTO AI tool designed to perform automated prior art searches before substantive examination begins. When an eligible patent application is filed under the program, the USPTO’s system runs an AI-assisted search based on the application’s text, claims, and classification data. The output is a concise report called an Automated Search Results Notice (ASRN), which lists up to ten potentially relevant prior art documents, ranked by relevance. The ASRN is then shared with the applicant early in the process, before the examiner conducts a formal search or issues an Office Action. Importantly, the ASRN is not considered an official communication under 35 U.S.C. § 132, so no response is required. 

Eligibility and Participation

Participation in the pilot is voluntary and limited. According to the Federal Register notice, up to 1,600 applications will be accepted, with quotas spread across different Technology Centers (roughly 200 per TC).

To qualify, an application must:

• Be an original, noncontinuing, nonprovisional utility application under 35 U.S.C. § 111(a);
• Be filed electronically in Patent Center and comply with USPTO’s DOCX filing requirements;
• Have the applicant enrolled in the Electronic Office (e-Office) program; and
• Include a petition to participate (anticipated form PTO/SB/470) along with the required petition fee under 37 CFR 1.17(f).

Applications such as continuations, divisionals, PCT national stage entries, plant, design, and reissue patents are excluded.

Challenges and Questions Ahead

While the pilot promises efficiency and transparency, it also raises questions.

• Accuracy and relevance. The AI search is limited to ten references. In complex fields, that might not capture the full scope of relevant prior art.
• AI bias and transparency. The USPTO will need to ensure the search algorithm operates fairly and explainably, avoiding over-reliance on machine output.
• Applicant behavior. Because responses to the ASRN are optional, uptake may vary widely depending on strategy and attorney familiarity with the tool.
• Impact on examiner workflow. Integrating AI-generated searches into traditional examination could create redundancy or confusion if not managed carefully.

Still, as a proof of concept, the Automated Search Pilot Program marks an important step toward a more data-driven, AI-assisted patent system, one where technology and human expertise work together to strengthen patent quality and efficiency.
